Catch Terms of Service

Last Updated: 2026-09-07

Placeholder notice: "[Catch LLC]" below is a placeholder until the LLC is formed and named. This document has not yet been reviewed by an attorney — see the cover note delivered alongside this file for what still needs legal review before this is treated as final or published to real users.

These Terms of Service ("Terms") are a legal agreement between you and [Catch LLC], a New York limited liability company (to be formed) ("Catch," "we," "us," or "our"), governing your access to and use of the Catch rowing-team management application (the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to create an account yourself. The Service enforces this: an account that gives a date of birth under 16 is refused at sign-up and told to ask their coach.

Athletes under 16 are added to a team by their coach, and their participation requires a parent or legal guardian to approve it through the guardian-consent process before the athlete can use the Service. If you are between 16 and the age of majority in your jurisdiction, you represent that you have your parent's or legal guardian's permission to use the Service, and that a parent or guardian has reviewed these Terms and our Privacy Policy.

If you are a coach or team administrator entering information about an athlete (including a minor), you represent that you have the legal authority and appropriate consent (e.g., from the athlete, their parent/guardian, or your organization, as applicable) to do so.

2. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must notify us promptly of any unauthorized use of your account or any other security breach you become aware of.
  • You agree to provide accurate information when creating your account and to keep it up to date.
  • One person should not maintain more than one account, except where a role change (e.g., changing roles within a team) is handled through the Service's own supported flows.

3. Subscriptions, Licenses & Payment

The Service may be offered to teams under a paid subscription or license model. As of this version of these Terms, no live payment processing is active in the Service; dues/fee-tracking features record balances and reminders manually entered by your team, not real financial transactions.

Once paid subscriptions or licenses are introduced:

  • Pricing, billing cycle, and renewal terms will be presented to you (or your team's administrator) at the time of purchase and will be incorporated into these Terms by reference.
  • Payment processing will be handled by a third-party payment processor; Catch does not directly store your full payment card details.
  • Refund and cancellation terms will be specified at that time and added to this section.

4. Affiliate Links & Brand Partnerships

Catch's business model includes revenue from team subscriptions/licenses and from affiliate links and brand partnerships (for example, with rowing equipment, apparel, or related brands). We do not sell, rent, or trade your personal information as a source of revenue. Any affiliate or partnership arrangement that would involve sharing your personal account information with a third-party brand will be clearly disclosed at the time, and, where required by law, will require your opt-in consent — see our Privacy Policy, Section 4.2, for more detail.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose, or in violation of any applicable local, state, national, or international law;
  • Enter false, misleading, or another person's information without authorization;
  • Attempt to access another user's account, or data you are not authorized to view (including attempting to bypass the Service's role-based access or safeguarding restrictions);
  • Interfere with or disrupt the integrity or performance of the Service (including attempting to probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures);
  • Use the Service to harass, bully, or endanger any other user, including any athlete under 18;
  • Upload or transmit any content that is unlawful, defamatory, or violates the rights of any third party.

We may suspend or terminate accounts that violate this section, as described in Section 10.

6. User Content and Coach-Entered Data

"User Content" means any information, data, messages, or files you or your team submits to the Service — including roster information, attendance records, chat/comms messages, coaching notes, and athlete performance data.

  • You (or, for coach-entered records about an athlete, the athlete's team/organization) retain ownership of your User Content.
  • You grant Catch a limited license to host, store, transmit, and display your User Content solely as necessary to operate and provide the Service to you and your team.
  • You are solely responsible for the accuracy and legality of any User Content you submit, and for having the right to submit it (see Section 1 regarding entering information about minors).
  • Coaching staff acknowledge that certain fields (medical notes, injury logs, staff observations) are restricted, safeguarding-sensitive information, and agree to use those features only for legitimate coaching/safety purposes consistent with their role and any applicable school, club, or governing-body policies.

7. Third-Party Services

The Service integrates with or relies on certain third-party services (for example, weather data, and in the future potentially fitness-device or payment integrations). Catch does not control, and is not responsible for, the availability, accuracy, or practices of these third-party services. Your use of any third-party service accessed through the Service may be subject to that provider's own terms.

8. Intellectual Property

The Service, including its software, design, graphics, and branding (excluding your own User Content), is owned by Catch or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer it, except as permitted by law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any data will be accurate, complete, or preserved without loss.

Catch is a team-management and communication tool. It is not a substitute for professional medical judgment. Any health, injury, or medical-adjacent information recorded in the Service (weight, injury logs, medical notes) is provided by coaches and other users, not verified or reviewed by Catch, and should not be relied upon as a substitute for consulting a qualified medical professional, athletic trainer, or other appropriate authority.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Catch, its owners, and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service.
  • Catch will not be liable for any unauthorized access to, alteration of, or loss/disclosure of your information, including as the result of a security breach, hacking, or other unauthorized third-party conduct, provided Catch has implemented and maintained the security measures described in our Privacy Policy. This limitation does not apply where prohibited by law, and does not limit any statutory obligations Catch has to notify affected users of a data breach (see our Privacy Policy, Section 6).
  • Catch's total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you (or your team) paid Catch in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
  • Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you, and nothing in this section limits any liability that cannot be limited under applicable law (including, where applicable, liability for gross negligence, willful misconduct, or fraud).

Note for legal review: the limitation-of-liability and disclaimer language above is standard, strong protective language, but it is not an absolute guarantee of zero liability — no contract can override certain non-waivable statutory obligations (e.g., New York's SHIELD Act data-security/breach-notification requirements, or protections specific to minors' data). This entire section, and its interaction with the safeguarding/minors data handled by the Service, is exactly the kind of language that should be reviewed by an attorney familiar with New York law and, ideally, with youth-sports or health-adjacent data specifically, before this is relied upon.

11. Indemnification

You agree to indemnify, defend, and hold harmless Catch, its owners, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another person, except to the extent caused by Catch's own breach of these Terms or violation of applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and request account deletion at any time (see our Privacy Policy, Section 8). Provisions of these Terms that by their nature should survive termination (including Sections 8 through 13) will survive.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Saratoga County, New York, and you consent to personal jurisdiction there.

Note for legal review: whether an arbitration clause, class-action waiver, or other dispute-resolution mechanism should be added here (common in consumer-facing ToS) is a decision to make with counsel, not something drafted here without legal input.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as an in-app notice or updated "Last Updated" date) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Catch regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
